Introduction and Acceptance of Terms
Welcome to TeachMap AI. These Terms of Service constitute a legally binding agreement between you and TeachMap AI governing your access to and use of our Service.
TeachMap AI ("we," "us," "our," or the "Company") is an artificial intelligence-powered educational platform that provides lesson plan generation, AI tutoring, and interactive educational games for learners of all ages (the "Service").

- AI Tutor ("Carta AI"): An intelligent tutoring system that provides personalized learning assistance, answers questions, and guides learners through educational content.
- Educational Games ("Learning Hub"): Interactive, gamified learning experiences including flashcards, quizzes, spelling exercises, and other educational activities.
- Voice and Speech Features: Text-to-speech and speech-to-text capabilities powered by Google AI to enhance accessibility.
- Progress Tracking: Tools to track learning progress, achievements, and educational milestones.
User Accounts and Eligibility
3.1 Age and Eligibility
Our Service is designed for learners of all ages. However, different rules apply based on age:
- Users 18 and older: May create accounts and use all features independently.
- Users ages 13-17: May create accounts with parental or guardian consent.
- Users under 13 (COPPA Compliance): Must have an account created and supervised by a parent, guardian, or educational institution.
3.2 Educational Institution Use
If our Service is used in an educational setting, the educational institution is responsible for:
- Obtaining necessary parental consents where required by law
- Ensuring compliance with applicable student privacy laws (FERPA, COPPA)
- Supervising student use of the Service
- Managing student accounts appropriately
3.3 Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and notify us immediately of any unauthorized access.
Acceptable Use Policy
You agree to use the Service only for lawful educational purposes. You agree NOT to:

- Generate content that is unlawful, harmful, threatening, abusive, or discriminatory
- Use the Service to create content that promotes violence or illegal activities
- Create content that infringes upon intellectual property rights
- Use the Service for academic dishonesty, plagiarism, or cheating
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems or bots that exceed reasonable use
- Reverse engineer or attempt to extract source code
- Collect personally identifiable information from other users
- Impersonate any person or entity
- Interfere with or disrupt the Service
Google AI Services and Third-Party Processing

- When you request a lesson plan, your input is sent to Google's AI services for processing
- When you interact with our AI Tutor, your questions are processed by Google's AI
- When you use voice features, audio data is processed by Google's speech services
5.2 Google's Terms and Policies
Your use of our AI features is also subject to Google's Terms of Service and Privacy Policy.
5.3 Service Availability
Our Service depends on the availability of Google's AI services. We cannot guarantee uninterrupted access to AI-powered features if Google's services experience downtime or discontinuation.
AI-Generated Content
6.1 Nature of AI Content
The Service utilizes artificial intelligence to generate educational content. You acknowledge that:
- AI-generated content may contain errors, inaccuracies, or incomplete information
- Content should be reviewed and verified by qualified individuals before use
- AI content does not constitute professional educational, medical, legal, or financial advice
- Quality depends significantly on the specificity of user inputs

For Educators

- Your Input: You retain ownership of content you input into the Service.
- Generated Content: You are granted a perpetual, royalty-free license to use, modify, and distribute content generated for you.
- Our License: You grant TeachMap AI a license to use your input solely for operating and improving the Service.
Subscription Plans, Payments, and Refunds
7.1 Service Tiers
We offer a Free Tier with limited access and Paid Subscriptions with expanded features and limits.
7.2 Billing and Payments
Subscription fees are billed in advance on a recurring basis. Payments are processed securely by Stripe, Inc. and are subject to Stripe's privacy policy and terms.
7.3 Cancellation Policy
You may cancel your subscription at any time. Upon cancellation, your subscription remains active until the end of your current billing period, after which your account reverts to the free tier.
7.4 Refund Policy

Intellectual Property Rights
The Service, including its original content, features, functionality, design, and trademarks, are the exclusive property of TeachMap AI and its licensors, protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, reverse engineer, or create derivative works based on the Service without express written consent.
Copyright and DMCA Policy
TeachMap AI respects intellectual property rights. If you believe content infringes your copyright, submit a DMCA notice to support@teachmap.org including:
- Physical or electronic signature of the copyright owner
- Identification of the copyrighted work
- Identification and location of the infringing material

- Accuracy statement under penalty of perjury
Disclaimers and Warranty Exclusions
Disclaimer
We expressly disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy of AI-generated content, uninterrupted service, and educational outcomes.
Limitation of Liability
Maximum Liability
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, or damages resulting from reliance on AI-generated content.
Indemnification
You agree to defend, indemnify, and hold harmless TeachMap AI from claims arising from your use of the Service, violation of these Terms, violation of third-party rights, or your use of AI-generated content.
Dispute Resolution and Arbitration
13.1 Informal Resolution
Before formal dispute resolution, contact us at support@teachmap.org to attempt informal resolution within 30 days.
13.2 Binding Arbitration
Unresolved disputes shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Consumer Arbitration Rules.
13.3 Class Action Waiver

While we strive for high availability, we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.
We shall not be liable for failures due to force majeure events including natural disasters, war, pandemic, internet failures, or third-party service failures.
Account Termination

You may terminate your account at any time through account settings or by contacting us.

We may suspend or terminate your account immediately for breach of Terms, suspected fraud, or any reason at our discretion.
